Rental agreement.
Last updated October 27, 2026
This agreement applies to the rental summary shown with the customer's booking, including the confirmed equipment, dates, addresses, price and tax. The dated version accepted before payment governs that rental.
1. Requesting and confirming a rental
Submitting a request does not reserve equipment. YOYO first reviews the requested package, dates, delivery and pickup addresses, equipment availability and final price.
All totes, dollies and accessories remain the exclusive property of YOYO Totes throughout the rental. The person submitting and paying for a rental must be at least 18 years old, must be authorized to enter into this agreement and must provide accurate contact, delivery and pickup information.
After approving the request, YOYO emails the customer the confirmed equipment, dates, addresses and price, together with a secure Stripe payment link and links to this Rental Agreement and Payment Authorization. The customer accepts the Rental Agreement and Payment Authorization at Stripe checkout before paying. YOYO tentatively holds the requested equipment for 24 hours after sending the approval email. The booking is confirmed only after full payment is received.
If the customer does not complete acceptance and payment within 24 hours, the tentative hold and quoted price expire, and YOYO may deactivate the payment link and release the equipment for another customer. Payment after that deadline does not confirm the booking unless YOYO first reconfirms availability and the price. YOYO may set a shorter, clearly disclosed deadline for a last-minute booking.
2. Payment method and later charges
The customer pays the full approved rental balance before delivery. YOYO does not collect payment when the initial request is submitted.
Sales tax is added as required by Pennsylvania law at the rate for the delivery address: 6%, or 8% for deliveries in Philadelphia. It applies to rental and extension fees and to cleaning, damage and missing-equipment charges.
Stripe securely processes the payment and saves the payment method for the limited purpose of settling the rental. YOYO does not store the customer's full card number.
Payment authorization. I authorize YOYO Totes LLC to save the card I use today with Stripe and to charge it, without asking me again at the time of the charge, only for:
1. Changes I request and approve, such as a rental extension or a reschedule with less than 48 hours' notice. YOYO charges these when it confirms the change.
2. Charges arising during my rental: an unapproved late return, a failed delivery or pickup, excessive cleaning, missing equipment, or equipment damaged beyond normal wear. The amounts are the fixed charges in YOYO's Rental Policies, plus any applicable sales tax.
For charges in item 2, YOYO will email me an itemized notice at least 24 hours before charging. If I tell YOYO before then that a charge is wrong, YOYO will not make that charge until it has reviewed my concern and replied in writing. If a charge is declined, YOYO will send me an invoice.
This authorization ends when YOYO has collected and inspected all returned equipment, any unreturned equipment has been resolved under Section 11, and my balance is settled. YOYO will not use the payment method for an unrelated or future rental without new permission.
3. Rental period
The standard rental period is 14 days. Pickup is scheduled 14 calendar days after delivery. The confirmed delivery and pickup dates appear in the customer's payment summary and confirmation email.
Returning equipment early does not create a partial refund. If YOYO delivers late, the pickup date moves accordingly so the customer receives the full paid rental period.
Changes to the delivery date, pickup date or either address require YOYO's approval and remain subject to availability. A different pickup address is permitted only when disclosed and approved in advance. Both addresses must be within YOYO's service area, and YOYO will disclose any additional delivery charge before payment.
YOYO and the customer will agree on a delivery and pickup window. An exact arrival minute is not guaranteed.
If YOYO misses or reschedules a pickup for any reason not caused by the customer, no extension charge applies for that delay.
4. Extensions
To extend, the customer asks YOYO at least 48 hours before the scheduled pickup. YOYO confirms availability, the new pickup date and the price. The extension is approved once the customer accepts and payment succeeds.
Extensions are sold in seven-day increments and are not prorated:
- Small Move, 20 totes: $35 per additional week
- Medium Move, 40 totes: $55 per additional week
- Large Move, 60 totes: $75 per additional week
- Custom quantity: $15 plus $1 per tote per additional week, with a $25 minimum
If equipment is not available at the scheduled pickup and no extension was approved, one seven-day extension charge at the rate above applies as of the scheduled pickup date. A further seven-day charge applies if the equipment is still not returned 7 days later. Each charge follows the notice process in Section 2. If YOYO attempted the pickup, the $25 failed-pickup fee also applies. Paying these charges does not give the customer the right to keep the equipment, and Section 11 explains what happens if it remains unreturned.
5. Cancellation and rescheduling
- Cancellation at least 48 hours before the scheduled delivery: full refund.
- Cancellation less than 48 hours before delivery: refund minus a $25 cancellation fee.
- Cancellation after delivery: no refund.
- Rescheduling with at least 48 hours' notice: no fee, subject to availability.
- Rescheduling with less than 48 hours' notice: $25, subject to availability, charged when YOYO confirms the new date.
- If YOYO cannot fulfill the booking before delivery: full refund.
Refunds are initiated within 5 business days to the original payment method. Card issuers may take longer to post them. YOYO may waive a cancellation or rescheduling fee for severe weather, a genuine emergency or another reasonable circumstance at its discretion.
If the customer reschedules at least 48 hours before the original delivery, the cancellation deadline moves with the new confirmed delivery date. If the customer reschedules within 48 hours of the original delivery, rescheduling does not reset the cancellation deadline unless YOYO agrees otherwise in writing.
6. Standard delivery and pickup
The package price includes delivery to and pickup from a safe, accessible ground-level location. Examples include a driveway, garage, front entrance, accessible lobby or apartment loading area.
Standard service does not include carrying totes up or down stairs, through the customer's home or into individual rooms. YOYO handles only empty, nested totes and empty dollies. YOYO does not pack, load, unload or move filled totes.
YOYO is an equipment rental business, not a moving or storage company. YOYO provides only the rental, delivery and pickup of its own empty equipment. YOYO does not pack, load, unload, carry, haul, store or transport customer belongings and never takes possession, custody or control of them.
The customer must provide accurate delivery and pickup addresses, legal and reasonably close parking access, access instructions, a clear and safe path, and a reachable contact during the agreed service window.
The customer does not need to be present if a secure unattended location is approved in advance. Once YOYO completes and photographs an unattended delivery at the customer's approved location, the equipment is considered in the customer's possession.
At delivery, YOYO counts and photographs the equipment and emails the customer a delivery receipt. If the count is wrong or an item arrives visibly damaged, the customer must tell YOYO within 24 hours; otherwise, the count and visible condition shown on the receipt are treated as accurate. This does not affect the customer's right to report equipment that fails during normal use.
The customer is responsible for the equipment from completed delivery until YOYO collects it. For an unattended pickup, YOYO bears the risk of loss from the end of the agreed pickup window only if YOYO has not arrived by then, and the customer placed all of the equipment at the approved location no earlier than the start of the agreed pickup window and sent YOYO a photo of it there.
YOYO counts and photographs the equipment at pickup and inspects it within 48 hours. YOYO will not add any damage, cleaning or missing-equipment charge after that 48-hour period.
At pickup, all totes must be empty, reasonably clean, nested and available at the agreed location. Dollies and other rented equipment must be returned with them. YOYO may refuse an unsafe delivery or pickup location and arrange another option.
7. Failed delivery or pickup
A $25 additional-trip fee applies when YOYO arrives during the agreed window but cannot complete delivery or pickup because the customer did not provide access, accurate instructions, a safe location or a reachable contact.
- Failed delivery or required redelivery: $25
- Failed pickup or required return trip: $25
YOYO will waive the fee when the problem was caused by YOYO, severe weather or another circumstance YOYO determines was reasonably outside the customer's control.
If a pickup fails and the equipment remains with the customer past the scheduled rental period, the applicable extension charge may also begin.
8. Acceptable use
Each tote may hold no more than 50 pounds. The equipment is intended for ordinary household or office belongings.
Equipment may be used by the customer, by friends, family members or other people helping with the move without pay, and temporarily by a professional mover the customer hires. The customer is responsible for unpaid helpers' use of the equipment. Equipment may be used only at the approved delivery, moving and pickup locations. Temporary handling by a hired mover is permitted, but the equipment may not otherwise be sold, rented, loaned, transferred or taken to an unapproved location without YOYO's approval. The customer must tell any hired mover that the equipment belongs to YOYO and that each tote has a 50-pound limit. The customer must promptly report equipment that is lost or stolen.
Customers may not use the equipment for hazardous materials, gasoline or fuel, corrosive chemicals, wet paint, biohazards, illegal items or anything likely to leak or contaminate the equipment. Food, toiletries and other liquids must be securely sealed.
Customers must keep the equipment reasonably protected from weather, use dollies and stacked totes safely, avoid standing or climbing on totes, avoid altering or permanently marking the equipment, use only YOYO-approved removable labels, and report visible arrival damage within 24 hours.
The customer is responsible for packing, lifting and transporting all filled totes.
YOYO provides clean equipment in sound working condition. If any equipment arrives damaged, or fails during normal use, the customer should stop using it and contact YOYO. YOYO will replace it when reasonably possible, or give a refund or credit for that item.
Warranty limits. Except for YOYO's express promise above, and to the fullest extent permitted by law, YOYO disclaims all implied warranties, including the implied warranties of merchantability and fitness for a particular purpose. To the fullest extent permitted by law, replacement or a refund or credit for the affected item is the customer's exclusive remedy for defective equipment. If that remedy fails of its essential purpose, the customer may recover direct damages, subject to the limitation of liability in Section 12.
9. Normal wear, damage and missing equipment
Normal wear does not create a charge. Normal wear includes ordinary scuffs, scratches and light signs of moving use that do not affect safety or reuse.
The following fixed replacement charges apply to missing equipment or damage that makes it unsafe or impractical to reuse:
- Missing or unusably damaged tote: $25 each
- Missing or unusably damaged dolly: $75 each
Examples of chargeable damage include a cracked or punctured tote, broken attached lid or hinge, melted or badly warped plastic, permanent contamination, or a dolly with an unusable platform, frame or caster system.
YOYO will count and inspect the equipment at pickup and will notify the customer of an issue within 48 hours. The notice will explain the charge and include photographs when relevant.
10. Cleaning
Routine cleaning and sanitizing between rentals are included in the rental price. YOYO does not charge for ordinary dust, light dirt, scuffs or normal moving use.
Excessive cleaning is charged at $10 per affected tote, up to a maximum cleaning fee of $50 per rental.
Permanent marker, paint, adhesive, chemicals, strong odors or other contamination that cannot reasonably be removed may result in the $25 tote replacement charge instead of a cleaning fee.
11. Overdue and unreturned equipment
YOYO will not let weekly charges continue indefinitely.
Day of missed pickup. If equipment is not available at the scheduled pickup and no extension was approved, the charges in Section 4 apply, and YOYO will contact the customer by email, text and phone.
7 days after the missed pickup. If the equipment is still not returned and no arrangement is agreed, a second seven-day charge applies. YOYO will also mail a written demand to return the equipment to the delivery, pickup or other address the customer provided.
14 days after the missed pickup. If the equipment is still not returned, YOYO will treat it as unreturned and charge $25 per tote and $75 per dolly, plus tax, after notice under Section 2. Weekly charges stop once replacement charges apply.
Late return. If the customer returns usable equipment within 30 days after replacement charges are made, YOYO will refund the replacement charge and its tax for each usable item returned, minus any unpaid charges under these policies. After that period, YOYO keeps the replacement charge and will no longer seek the return of the items it was paid for, and ownership of those items passes to the customer.
YOYO will not enter a home or other private space to recover equipment without permission. YOYO may pursue unpaid amounts and the return of its equipment through any lawful means, including court action.
If the customer does not meet this agreement. If the customer keeps, loses or damages YOYO's totes, dollies or accessories, or does not pay charges under this agreement, YOYO may charge the card the customer saved for this rental, ask the customer to return its equipment, and take legal action to recover the equipment or the amount owed.
12. Customer belongings, injuries and property
The customer is responsible for safely packing, lifting, stacking, securing and transporting their belongings. YOYO does not pack or move filled totes.
The totes are not represented as waterproof, theft-proof or appropriate for protecting fragile or unusually valuable property. YOYO is not responsible for damage caused by poor packing, overloading, shifting contents, weather exposure or customer misuse.
The customer is responsible for maintaining clear walkways and using totes and dollies safely. The customer is responsible for injuries or property damage caused by their misuse of the equipment.
Assumption of risk. The customer understands that packing, lifting, stacking and moving filled totes, and using dollies, involve risks such as strains, falls, dropped items, shifting loads and property damage. The customer accepts responsibility for performing these activities safely, choosing appropriate helpers and deciding how their belongings should be packed and moved.
Limitation of liability. To the fullest extent permitted by law, for a claim involving only economic loss or damage to property arising from a rental, including a claim based on YOYO's negligence, YOYO's total liability will not exceed the greater of the amount the customer paid for the rental or $500. YOYO is not liable for indirect, incidental or consequential damages such as mover charges, missed work, moving delays or loss of use. These limits do not apply to claims for personal injury or to YOYO's gross negligence, recklessness or intentional misconduct.
Claims involving helpers or other third parties. The customer will reimburse YOYO for reasonable losses, claims and costs, including reasonable attorney fees, resulting from a third-party claim—but only to the extent the claim was caused by the customer or by a friend, family member, volunteer or other person the customer brought to help without pay through unsafe use, misuse, overloading, packing, handling of the equipment or failure to follow this agreement. The customer is not responsible under this paragraph for a claim caused by or made by an independently hired professional mover, or to the extent the claim was caused by YOYO. Regardless of who handles the equipment, the customer remains responsible to YOYO for missing equipment or damage to YOYO's equipment under Sections 9 through 11.
Nothing in this section limits responsibility that cannot legally be limited.
13. Weather and service interruptions
YOYO may delay delivery or pickup when weather, road conditions, building access or another safety issue makes service unreasonable.
Weather-related rescheduling does not create a fee for either party. If YOYO delays pickup, the customer may keep the equipment until the rescheduled pickup without an extension charge.
YOYO will arrange the earliest reasonable replacement date. If YOYO cannot fulfill the rental before delivery, the customer receives a full refund. If a major delay makes the rental no longer useful before delivery, the customer may cancel for a full refund.
Except where liability cannot legally be excluded, YOYO is not responsible for indirect costs such as mover charges, missed work or moving delays caused by a service interruption.
14. Contact information, notices and governing law
The customer must give YOYO a current email address, phone number, delivery address and pickup address, and update them if anything changes during the rental. YOYO may send communications to the latest contact details and addresses the customer provided.
Pennsylvania law governs this agreement. Either party may bring a claim in any Pennsylvania court with jurisdiction and proper venue, including a magisterial district court or Philadelphia Municipal Court.
Entire agreement. The confirmed rental summary and the dated version of this agreement accepted by the customer are the complete agreement for that rental. The rental summary controls the confirmed equipment, dates, addresses, price and tax. This agreement controls the general rental terms. Together, they control over conflicting website content, FAQs, advertising or earlier communications.
No waiver. If YOYO waives a fee or does not enforce a term on one occasion, that does not waive the same fee or term on another occasion.
Severability. If any provision of this agreement is found unenforceable, the remaining provisions stay in effect. The affected provision will be enforced to the maximum extent permitted by law.
